Spain is one of the most popular countries for Western European expatriates. Madrid, Barcelona, Alicante, Marbella, and, of course, Mallorca are trending destinations. As an employee, you often have to expect significantly lower salaries in most cases. The main appeal is undoubtedly the mild climate, the Spanish lifestyle, and proximity to the sea.

But what if I work independently, remotely, or even start a business in the South, far from my home country? Does it really make sense as an entrepreneur, or are there better alternatives?

1. Generally high taxes

Income over EUR 60,000 per year is taxed at 45%.

There is one exception: the so-called Beckham Law.

This regulation states that income from employment up to €600,000 per year is taxed at only 24%. It also excludes foreign income from taxation, meaning the worldwide income principle does not apply up to this threshold.

A permanent employment contract and an immediate move to Spain are required; otherwise, it is considered a simulation (tax avoidance scheme).

    I would like to emigrate and start a company—first in Spain. But to be honest, as uncool as it may seem to some, I have to say Romania is the country for me. The sense of freedom is priceless. Question: Can I set up the company in advance so that when I move to Romania in a few months, it is fully operational?

    Everything can be done remotely without traveling, as far as I’ve heard. I did it on-site with another provider and unfortunately had to travel three times! 1x for the company formation, 1x for the bank account, and 1x for the power of attorney for the tax advisor (which can only be done via a notary). I could have saved myself the trouble!

    Setting up a company within the EU is a common practice and occurs frequently every day – even if the founder's residence is not in the country of establishment, but in their home country. Setting up a company is not a problem. Regarding tax recognition by the domestic tax authorities, it should be noted that the entire process is based on a double taxation agreement. If its guidelines are adhered to, recognition is guaranteed. This procedure is implemented in exactly the same way by hundreds of thousands of companies. A common practice and not a gray area.
